A court fight is pending in Austin two years after the Texas Commission on Environmental Quality (TCEQ) granted a permit to build a wastewater treatment plant between Parker and Murphy. The plant, which could dump up to 200,000 gallons per day of treated effluent into Maxwell Creek, was sought by the developer of a housing development on 101 acres in Parker’s extraterritorial jurisdiction.
Restore the Grasslands, linked to the family trusts of Dallas developers Phillip and Donald Huffines, filed for the permit after the two nearby cities refused to provide sewer service to the community.
Meanwhile, a separate action to block creation of a municipal utility district (MUD) to operate the plant development remains pending before an administrative law judge who had approved the treatment plant.
